Boise State University (“the University”), Boise State Athletics (“Athletics”) and the Bronco Athletic Association (“BAA”), together referred to as “Boise State,” have established an athletic ticket and parking transfer policy to be reviewed on an annual basis. These guidelines are for the internal use of these entities and their ticket transfer process, and do not create any rights or entitlements in others. Boise State reserves the right, in their sole discretion, to deviate from such guidelines on a case-by-case basis.

 

 GUIDELINES FOR TRANSFER OR RENEWAL OF ATHLETIC TICKETS

The University owns and controls all rights to the seat locations for all home games. Purchasers of tickets, referred to as “Member(s) of Record,” receive a license, in the form of the ticket, to use the seat location for each of the designated home games. The University may revoke the license at any time, with or without cause, upon refunding the prorated portion of the actual purchase price, except in potential cases of fraud. The license is granted on a game-to-game basis, and is subject to all rules, regulations and policies relating to athletic events as established by Boise State.

A.    RENEWAL PRIVILEGE

The opportunity to renew season ticket(s) and parking for the next season is not guaranteed and is revocable at any time at the sole discretion of Boise State. This renewal privilege may only be exercised by the member of record upon payment in the amount and by the date established by Boise State. When deciding whether to revoke renewal privileges, the University will consider the member of record’s violation of rules, regulations, and policies of Boise State and the Idaho State Board of Education, including without limitation these terms and conditions, Boise State ticket policies, ticket and parking terms and conditions, trademark violations, violations of alcohol policy, violations of abusive spectator behavior, violations of any other University policy, and/or ticket scalping rules then in effect.

B.    SEASON TICKET AND PARKING TRANSFERS

The opportunity to transfer season tickets and parking is at the sole discretion of the University, Athletics, and the BAA, in accordance with the procedures set forth below.

The request for transfer does not guarantee transfer or renewal privileges, and the University, Athletics, and the BAA are not required to honor the request for transfer.

Transfers are recommended to take place during annual renewals.

C.   REQUEST FOR TRANSFER

As a condition to considering a request for transfer of Boise State Athletics season tickets, the Primary Account Member of Record must submit a Request for Transfer to the Boise State Athletic Ticket Office. Approval of a request for transfer of season tickets is at the sole discretion of Boise State.

D.   TICKET TRANSFER GUIDELINES

1.             Boise State reserves the right, in its sole discretion, to exclude certain seats and parking from transfer.

2.             Except in special circumstances at the discretion of Athletics or the BAA, season tickets may only be transferred from spouse to spouse, from parents to children, or between immediate family members.

3.             Exceptions to this may also be determined based on the type of tickets involved, the premium or priority status of seats/parking, or due to extenuating circumstances. 

4.             All requests for transfers must be initiated by the Primary Account Member of Record on the account, except in the case of the death of that Member of Record. (See section below regarding death-related transfers.)

5.             The Transfer Initiate must be in good standing with Boise State.

6.             Transfers to anyone other than a spouse must be to a separate account under the recipient. Priority points, membership status, and/or any other benefits, cannot be transferred. 

7.             Spouses may be added to accounts as a “Secondary” Member of Record, and Children may be added as an “Other” Member of Record, but Secondary and Other Members of Record do not have control privileges over the account.  

8.             Transfers must follow any pricing or membership requirements as determined by Boise State.

9.             As the owner and licensor of both seats and parking, Boise State is under no obligation to honor any legal claims or documentation.

E.    TRANSFERS IN REGARDS TO DEATH, DIVORCE, OR INCAPCITATION

In the event of death, divorce, or incapacitation, the following guidelines will be followed in conjunction with specific guidelines in Sections F through J. In these cases, Boise State ultimately retains final decision on all transfers and will act in good faith based on the evidence and totality of the circumstances of each case, including account history and legal documentation.

1.             In the event of the death of the Primary Member of Record, a surviving Spouse may request that account be moved to his/her name with no changes in membership benefits including priority points, contributions, parking, and other benefits. Transfers to spouses can be done at any time and spouses may be added on to an account in question as a Secondary Member of Record. Season tickets and parking must be maintained at the current market renewal pricing by the surviving spouse.

2.             In the event of the death of both the Primary and Secondary Members of Record, the tickets may be transferred to an Other Member of Record on the account.

3.             If there are no Other Members of Record, Boise State has no obligation to locate any potential transfer prospects. In such cases:

a.    Seats will be held on account through the season to allow for potential transfer. Unclaimed seats and parking will be moved to general availability the next renewal cycle.

 

b.    Tickets may be claimed by a direct family member as would be applicable under normal transfer guidelines.

4.             In the event of a divorce of the Season Ticket Member of Record, the Primary Member of Record is recognized as the primary account holder with complete access and control of the account. Secondary Members of Records as listed on the account will not be allowed to make any changes to the account, even with legal documentation, without the specific direction of the primary account holder. While tickets and parking may be split, only one individual may retain the priority points, membership, or benefits as determined by Athletics and/or the BAA, and points and financial history cannot be split between two accounts.

5.             In the event of incapacitation of the Primary Season Ticket Member of Record, legal Power of Attorney must be provided to Boise State.

F.    FOOTBALL & MEN’S BASKETBALL, Premium and Priority Seating

Season tickets in premium and priority areas (priority defined as areas determined by Boise State due to high demand and/or value) are eligible for transfer if the Transfer Recipient is:

1.             a BAA member at the current market donor level needed to acquire such seats, and

2.             Transfer Recipient pays the market price of the seats at the time of renewal.

NOTE: Market donor levels are based on the donor levels required the during the current and previous season and applicable wait lists or projections.

G.   FOOTBALL & MEN’S BASKETBALL, Non-Priority Seating

1.             Season tickets in non-premium and non-priority areas (priority defined as areas determined by Boise State due to lower demand and/or value) are eligible for transfer if the Transfer Recipient pays the current market price required to acquire the seats at the time of transfer.

H.   PARKING

Paid parking passes are eligible for transfer if:

1.             The Transfer Recipient must be a BAA member at the current market donor level needed to acquire the pass as well as pay the market price of the pass at the time of renewal.

NOTE: Market donor levels are based on the donor levels required the during the current and previous season and applicable wait lists or projections.

2.             Complimentary passes are subject to the nature of the complimentary status and may not be transferrable. 

I.      ALL OTHER SPORTS

Transferring tickets for these sports will follow the same guidelines as listed for football and men’s basketball non-priority seating in Section G.

J.     BAA MEMBERSHIPS

Individual BAA Memberships are non-transferrable, with the limited exception of specific pre-existing Lifetime Membership agreements.

K.    BUSINESS ACCOUNTS

Business accounts will be handled similarly to personal accounts unless otherwise noted.

1.             The Primary Member of Record will have ultimate control of the account, but a Secondary Member of Record will be allowed the privileges of the Primary Member of Record not overriding the Primary Member. 

2.             In the event a change is needed to an account where the members of record are no longer with the company, written communication from an official company email or letterhead can be submitted.

3.             Seats and parking may not be included as a part of the sale of a company; however, Boise State will consider such situations as a transfer.
